Event Announcements Terms and Conditions

1.  DESCRIPTION OF SERVICE
Welcome! This feature of the Red Hat Society website is provided for the purpose of sharing Red Hat Society Chapter Events Information with other chapters and members. (“Service”) Use of this request form for purposes of advertising or solicitation of any kind (commercial, charitable, or any other form of solicitation) is not permitted.

You must have a valid email address to announce your event.  If you choose to announce your event, other members will see your email address and use it to communicate with you about your event.  By agreeing to the Terms and Service you are giving the Red Hat Society permission to use your email address to facilitate the announcement of your event.

2.   ACCEPTANCE OF TERMS
By using the Red Hat Society website, you agree to be bound by the following terms and conditions (Terms of Service). In addition when using a particular RHS owned or operated service you are subject to any posted guidelines or rules applicable to such services as revised from time to time.  All such guidelines or rules ( including but not limited to our Chapter Event Policies, Website Privacy Statement, Membership Terms and Conditions, Website Terms and Conditions, and Logo and Trademark Usage)  are incorporated by reference into the Terms of Service.

We may modify or terminate services from time to time, for any reason, and without notice.  You agree that the Red Hat Society will not be liable to you or any other any third party for any modification, suspension or discontinuance of the Service.

3.   RESPONSIBILITY FOR CONTENT
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not the Red Hat Society, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service.  The Red Hat Society does NOT control the Content posted via the Service and, as such, does NOT guarantee the accuracy, integrity or quality of such Content.  Under no circumstances will the Red Hat Society be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service. 

You agree not to use the Service to:

a. Collect or store personal data about other users;
b.  Upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
c. Impersonate any person or entity, including, but not limited to, a Red Hat Society official, forum leader, guide or host, or falsely state or otherwise misrepresent your identity or affiliation with a person or entity;
d. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
e. Upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
f. Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "spam,", "pyramid schemes," or any other form of solicitation;
g. For personal profit and
h.  Plan a event to substantially conflict with an event planned by the Red Hat Society;

You acknowledge that the Red Hat Society may or may not pre-screen Content, but that the Red Hat Society and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. Without limiting the foregoing, the Red Hat Society and its designees shall have the right to remove any Content that violates the its Terms of Service or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by the Red Hat Society or submitted to the Red Hat Society, including without limitation information in Red Hat Society message boards, and in all other parts of the Service.

4. RED HAT SOCIETY’S MEMBERS OBLIGATION
In consideration of your use of the Service, you represent that  you are 18 years or older to form a binding contract.  You also agree to: (i) provide true, accurate, current  and complete information about yourself as prompted by the Service’s registration form (“Event Details”) and (ii) maintain and promptly update the Event Details to keep it true, accurate, current and complete.  If you provide any information that is untrue, inaccurate, not current or incomplete, Red Hat Society has the right to suspend or terminate your account and refuse any and all current or future use of the Service. 

5.  INDEMNITY
You agree to indemnify and hold Red Hat Society and its Subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Service or your violation of any rights of another.

6.  DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT :

1. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.  THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.  THE RED HAT SOCIETY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS,  EMPLOYEES, AGENTS, PARTNERS , CONTRACTORS, LICENSORS AND LICENSEES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGMENT.
2. THE RED HAT SOCIETY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO WARRANTY THAT (i) THE SERVICE WILL MET YOUR REQUIREMENTS;  (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE RESULTS WHICH MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

c.   ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
d.  NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM RED HAT SOCIETY OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF SERVICE.

7. LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE RED HAT SOCIETY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, CONTRACTORS, LICENSORS, AND LICENSEES SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE RED HAT SOCIETY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

8. GENERAL PROVISIONS
Entire Agreement. The Terms of Service constitutes the entire agreement between you and The Red Hat Society and governs your use of the Service, superseding any prior agreements between you and the Red Hat Society with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Red Hat Society services, and  affiliate services.

Choice of Law and Forum. The Terms of Service  and the relationship between you and the Red Hat Society shall be governed by the laws of the State of California without regard to its conflict of law provisions.
